1.3 Response to Notice

Upon receipt of a proper notice of infringement, we will:

  • Promptly remove or disable access to the allegedly infringing material.
  • Notify the user who posted the material of the takedown.
  • Provide the user with a copy of the notice of infringement.
  • Take reasonable steps to preserve evidence of the allegedly infringing activity.

2. Counter-Notice Procedure

If a user believes that the material was removed or access to it was disabled as a result of a mistake or misidentification, they may submit a counter-notice by providing the following information to our designated DMCA agent:

  • Identification of the removed material: Provide the URL or other specific location on our website where the material was located before it was removed.
  • Contact information: Provide your full name, address, telephone number, and email address.
  • Statement of belief: Include a statement that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.
  • Statement of consent: Include a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which we may be found, and that you will accept service of process from the person who provided the notice of infringement or an agent of such person.

Upon receipt of a proper counter-notice, we will:

  • Promptly provide the person who filed the original notice of infringement with a copy of the counter-notice.
  • Wait at least 10 business days after providing the copy of the counter-notice to the original filer, or until we receive notice from the original filer that they have filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on our website, whichever is earlier.
  • If we do not receive notice from the original filer within the specified time period, we will promptly restore access to the material that was removed or disabled.

3. Repeat Infringer Policy

We have a policy for dealing with repeat infringers. If a user is found to be a repeat infringer, we will take appropriate action, which may include terminating the user’s access to our website.

4. Safe Harbor Compliance
