Recent events have brought to light a disturbing pattern of judicial interference by the APNU+AFC coalition, both during their tenure in government and in their current role as the opposition. This behavior raises serious concerns about the respect for the rule of law and the independence of Guyana’s judiciary.
During their time in office from 2015 to 2020, the APNU+AFC coalition faced criticism for actions that appeared to compromise judicial integrity. A notable instance was the unilateral appointment of James Patterson as GECOM’s Chairman in 2019. This move was later revoked by the Caribbean Court of Justice (CCJ), highlighting the coalition’s disregard for proper constitutional procedures.
The coalition’s attempts to influence the judiciary became even more apparent during the contentious 2020 election period. Multiple legal challenges were filed in an apparent effort to delay or prevent the declaration of election results. These actions were widely condemned by international observers as attempts to subvert the democratic process.
More recently, as the opposition, APNU+AFC has continued its pattern of judicial interference. A prime example is the recent challenge to the appointment of acting Police Commissioner Clifton Hicken. Attorney General Anil Nandlall described this action as “political interference” and part of a “vendetta” against public officials.
Legal experts have expressed concern over these tactics. Dr. Arif Bulkan, a constitutional law expert, stated, “The repeated attempts to use the courts for political purposes undermine public confidence in the judiciary and threaten the very foundations of our democracy.”
The opposition’s actions have not gone unnoticed by the international community. In 2020, the U.S. Secretary of State imposed visa sanctions on individuals “undermining democracy” in Guyana, a move widely interpreted as a response to the APNU+AFC’s post-election maneuvers.
Critics argue that these actions by APNU+AFC represent a dangerous trend of politicizing the judiciary. “When political parties attempt to use the courts as tools for their agenda, it erodes the separation of powers that is crucial for a functioning democracy,” said Mary Ali, a prominent local attorney.
As Guyana continues to navigate its political landscape, the importance of maintaining an independent judiciary cannot be overstated. The ongoing attempts by APNU+AFC to influence judicial processes raise serious questions about their commitment to democratic principles and the rule of law.
The government and civil society organizations have called for an end to these practices, emphasizing the need for all political actors to respect the independence of the judiciary.
